Previous Amendments
  • All of the following are considered commercial activities:

    • A- Any purchase of goods or commodities, including food items, for the purpose of selling them as they are or after processing and manufacturing.

    • B- Any contract or commitment to supply items or work related to trade on a commission basis or transportation by land or sea, or related to commercial shops, offices, and auction sales, known as الحراج.

    • C- Anything related to remittance bonds of all types or to currency exchange and brokerage (intermediation).

    • D- All contracts and commitments made between traders, intermediaries, brokers, money changers, and agents of all kinds, as well as all contracts related to the construction of buildings and similar matters.

    • E- Any activity related to the construction of commercial or sailing vessels, their repair, sale, or purchase domestically and internationally, as well as anything related to their leasing or renting, or the sale or purchase of their machinery, tools, and supplies, the wages of their workers, and the salaries of their crew and servants, as well as any lending or borrowing that occurs on the vessel or its cargo, and all guarantee contracts related to it, along with all contracts related to other maritime trade matters.

Article 5

Every merchant must conduct all their commercial activities with honesty and integrity, refraining from committing fraud, deception, cheating, unfairness, uncertainty, breach of trust, or anything that contradicts honesty and integrity in any form. If they do so, they shall be subject to the deterrent penalty pursuant to the Penal Code incorporated in this Law.
