Rules for licensing the provision of intellectual property services

Chapter One: Definitions, Objectives, and Scope of Licensing

Article 1: Definitions

  • The following terms and expressions, wherever mentioned in these rules, shall have the meanings assigned thereto, unless the context indicates otherwise:

    • The Authority: The Saudi Authority for Intellectual Property.

    • The Board: The Authority’s Board of Directors.

    • The CEO: The Chief Executive Officer of the Authority.

    • Intellectual Property Laws: The rules and regulations for which the Authority has jurisdiction and supervises implementation.

    • Rules: Rules for licensing the provision of intellectual property services.

    • License: A document issued by the Authority granting the licensee the authority to provide intellectual property services.

    • Licensee: The natural person who obtained the license.

    • Intellectual property services: Submitting requests concerning protection subjects, before the Authority and on behalf of others.

    • Protection Subjects: Subjects protected under the intellectual property laws in the Kingdom.

    • Fee: The approved remuneration collected by the Authority in return for licensing.

    • The Register: The Authority database, in which the information of licensees - and all relevant amendments that may take place- are recorded.

    • Registration: recording the licensee's information in the register.

Article 3: Scope of License

  • Intellectual property services shall not be provided on behalf of others before the Authority, except after obtaining a license in accordance with the provisions hereof, with the exception of:

    • 1. Representatives of government entities.

    • 2. Agents of third parties according to legal proxies issued by the authorities having jurisdiction, who are not practicing -on a regular basis- the provision of intellectual property services, at a rate not exceeding Three (3) requests per year.

Article 4: Scope of Providing Intellectual Property Services

  • The licensee has the right to provide the intellectual property services stated herein, including, but not limited to:

    • 1- Submitting and drafting requests of protection subjects.

    • 2- Responding to the Authority’s inquiries and inspection reports on requests for protection subjects.

    • 3- Submitting the requirements, data and information necessary, concerning requests for protection subjects.

    • 4- Following up the status of requests, and making the amendments and observations during the legal periods.

    • 5- Paying of the fees specified for the subjects of protection.

    • 6- Providing any other services related to protection subjects.

Chapter II: Conditions of License Granting

Article 5: General Conditions

Previous Amendments
  • 1- Must be of Saudi nationality.

  • 2- Must have full capacity.

  • 3- Must be residing in the Kingdom.

  • 4- Must not be an employee in a government entity.

  • 5- Must not have been convicted of a limit or a penalty in a crime involving dishonor or breach of trust, unless rehabilitated.

  • 6- Must hold a bachelor's degree at a minimum in law or regulations, or sciences or engineering, or any other specialty accepted by the authority from one of the Saudi universities or its equivalent according to the university degree systems and regulations in force in the Kingdom.

  • 7- Must hold the qualifying exam certificate issued by the authority, except for the case mentioned in the provisions of Article (Sixth) of these rules.

  • 8- Payment of the prescribed financial fee for the license.

Article 6: Professional Qualification Examination

Previous Amendments
  • 1- The following conditions must be met to obtain the professional qualifying examination certificate issued by the Authority:

    • A. Achieving the required passing percentage as determined by the Authority.

    • B. Payment of the prescribed fee to obtain the qualifying examination certificate.

  • 2- An exemption from the requirement to obtain the qualifying examination certificate is granted to examiners of protection subject applications with previous work experience of no less than five years in the field of examination.

  • 3- The Authority, at its discretion, may require obtaining the qualifying examination certificate for the exceptions mentioned in paragraph (2) of this article, if it deems prior qualification necessary in one of the protection subjects.

  • 4- The validity of the qualifying examination certificate is five years from the date of issuance.

Article 7: Jurisdiction of the Authority

The Authority has jurisdiction for issuing, amending, renewing, suspending, canceling he license in accordance with the provisions hereof and the adopted laws.
