Statute of Private Schools

Article 1

  • The term "private school" in the application of this regulation refers to any non-governmental establishment that provides any type of public or private education prior to higher education. The following are not considered private schools for the purposes of this regulation:

    • A- Cultural centers and institutes established by foreign states or institutions under an agreement with the Government of the Kingdom of Saudi Arabia.

    • B- Schools established by political and consular representation bodies to educate the children of their employees only.

Article 2

  • It is not permissible to open a private school, transfer its ownership, change its location, or alter its educational stage except after obtaining a written license issued by a decision from the head of the supervisory authority in accordance with the procedures and conditions stipulated in these regulations.

Article 3

  • The private school may not accept cash or in-kind assistance from a foreign or international source except with the approval of the supervising authority.

Article 4

  • Private schools are subject to the supervision of the relevant government agency for the similar type of education and to inspections from technical, health, administrative, social, and financial aspects, as well as any other requirements necessary for the benefit of education, and they are also obligated to comply with its instructions.

  • The building of the private school may not be used for purposes other than education; however, a section of it may be allocated for the accommodation of students in the boarding section, provided that the requirements of the law, ethics, and public health regulations are observed.

Article 7

Previous Amendments
  • The owner of the private school shall be responsible before the authorities for the operation of his school in all aspects, and the following conditions must be met:

    • A- He must be at least twenty-five years old.

    • B- He must have at least an educational qualification equivalent to the type of education that the school will provide.

    • C- He must not have previously been convicted by a court of a criminal penalty for a crime that undermines honor and integrity.

    • D- He must not have previously been subjected to disciplinary action resulting in dismissal from government service or from a private school.

    • E- He must have a good reputation and be of good character.

Article 8

  • Each private school must appoint a director who is responsible for the technical and administrative aspects of the school, along with a sufficient number of administrative and specialist staff as determined by the supervising authority. The owner of the school may manage it if he meets the conditions stipulated in Article (7) of this regulation.

Article 9

  • It is required for each of the employees at the private school to meet the following conditions:

    • A- He must have a good reputation and be of good conduct.

    • B- He must not have been previously convicted by a court of a criminal penalty for a crime that undermines honor and integrity.

    • C- He must not have been previously subjected to disciplinary action resulting in dismissal from service.

Article 10

  • It is required for a member of the educational body to possess at least the qualifications required of those in similar positions in public schools.
