Rules for Engaging Experts and Determining Their Fees Before the Courts of the Board of Grievances

General Provisions

Article 1

The court may, when necessary, appoint an expert or three experts.

Selection of the Expert

Article 2

Licensed experts carry out the work, and it is permissible to utilize the expertise available from government entities.

Article 3

If the parties agree on an expert, the court shall approve their agreement. If the court selects an expert who is not specified in Article (2) of these rules or different from what the parties have agreed upon, it must state the reasons for this in the appointment decision.

Appointment of an Expert

Article 4

The court requests - as appropriate - before appointing the expert a number of expert proposals, provided that each expert's proposal includes a statement of the tasks they will undertake, their expertise in those tasks, the time required to complete them, and an estimate of their expenses and fees.

Article 5

  • The text of the appointment decision must include the following:

    • A. A precise statement of the Expert's mission, powers, and the urgent measures he is authorized to take.

    • B. The specific date for submitting the report and the minutes of the proceedings, not exceeding forty-five days from the issuance of the decision, with the court having the authority to extend this by thirty days if the expertise is with a governmental entity.

    • C. The date of the hearing set for the pleadings after the report is submitted.

  • The text of the decision - when applicable - also includes:

    • 1- The amount of the Advance Payment that must be deposited for the Expert's expenses and fees, and the deadline for its deposit.

    • 2- The name of the litigant responsible for depositing it.

    • 3- The amount that the Expert may withdraw for his expenses.

Article 6

The court - in the appointment decision - may provisionally exempt the litigant who is unable from depositing the advance payment until the task is completed, and in this case, the court does not set a deadline for depositing the advance payment.
