Regulations on the Financial Consideration for Licensing Frequency Use

Article 1

The following terms and phrases - wherever they appear in this Regulation - shall have the meanings set forth below, unless the context requires otherwise:
1- The Authority: Communications and Information Technology Commission.
2- High Usage Cities: The following cities and governorates: Riyadh, Jeddah, Mecca, Jubail, Dammam, Khobar, and Dhahran.
3- Other Cities: All cities other than the "High Usage" cities.
4 - High Usage Administrative Regions: The following administrative regions: Riyadh Region, Eastern Province, and Mecca Region.
5- Other Administrative Regions: All administrative regions other than the "High Usage" administrative regions.
6- Frequency Usage License: The permission to use specific frequencies for operation in a wireless station or in a geographical area or in a wireless device for a specified duration.
7- Wireless Station License: The permission to use a frequency for operation in a radio station based on technical specifications and standards.
8- Geographical Area License: The permission to use a frequency in a geographical area at the level of a city, administrative region, or the Kingdom.
9- Frequency Usage License in a Wireless Device: The permission to use frequencies in a wireless device operating on a frequency from a set of internationally coordinated frequencies for a specific radio service.

Article 2

1- The Authority is responsible for calculating, applying, and collecting the financial fees for all frequency usage licenses in the Kingdom.

2- The financial fees for frequency usage licenses in this Regulation are based on a single Gregorian year.

3- If the duration of the frequency usage license is less than a year or more than a year, the calculation of the financial fees shall be proportionate to the number of days of the license.

4- The minimum annual financial fee is (2000) Riyals for a radio station license for satellite service, and (200) Riyals for any other license.

5- The Authority shall establish a mechanism for issuing invoices for the financial fees for frequency usage licenses, the due date, the required payment period, and the procedures to be taken in case of delayed payment.

6- The Authority has the right to license frequency usage through a competitive mechanism. In this case, the determination of the financial fees for frequency usage licenses shall be based on the outputs of this mechanism.

7- The calculation of the financial fees for frequency usage is temporarily subject to the provisions and policies issued by the Authority in this regard.

8- The Authority may amend the list of densely used cities based on changes in the density of spectrum usage therein.

9- The Authority may amend the list of densely used administrative regions based on changes in the density of spectrum usage therein.

  • The financial counterpart for licenses to use frequencies in wireless devices is as follows:

  • 1. Aviation and Meteorology Services:

    • The annual financial counterpart for a license to use frequencies in a wireless device operating on a frequency from the internationally coordinated frequency bands for aviation and meteorology services is (200) Riyals per device.

  • 2. Maritime Services:

    • The annual financial counterpart for a license to use frequencies in a wireless device operating on a frequency from the internationally coordinated frequency bands for maritime services is (200) Riyals per device.

  • 3. Terminals Operating in Satellite Networks:

    • The annual financial counterpart for a license to use frequencies operating in terminal stations for satellite service networks is (10,000) Riyals per network.

Article 6

The financial counterpart for the use of frequencies shall not be collected in the following cases:

1. Low-power wireless devices that operate according to the specifications approved by the Authority.

2. Wireless devices that have been issued an approved technical specification by the Authority and do not require a frequency use license, such as devices for communication services for outdoor enthusiasts (wilderness), receiving-only devices, satellite receivers, television sets, radio astronomy equipment, remote sensing equipment, and the Global Positioning System (GPS).

3. Wireless devices used in safety services and internationally coordinated search and rescue systems for these purposes.

4. Scientific research purposes.

5. Any other uses that the Authority deems exempt, after the approval of the Authority's Board of Directors.

Article 7

1. The Authority is the entity responsible for interpreting the provisions contained in this Regulation, and it has the authority to issue the necessary Decisions for its implementation.

2. This Regulation shall come into effect after (ninety) days from the date of its approval, and it shall annul any provisions that conflict with it regarding the financial counterpart for the licensing of frequency usage.

3. Licenses for frequency usage issued prior to the enforcement of this Regulation are exempt from paragraph (2) of this article.
