Organizational Arrangements of the National Center for Inspection and Control

  • After reviewing in its session chaired by the Custodian of the Two Holy Mosques King Salman bin Abdulaziz Al Saud, the correspondence received from the Royal Court No. 65902 dated 23/9/1444 AH, including the letter of His Excellency the Minister of Municipal, Rural Affairs and Housing No. 4400358998 dated 4/5/1444 AH, regarding the final meeting minutes of the Coordinating Committee for Inspection and Control Missions.
  • After reviewing Council of Ministers Decision No. (616) dated 20/10/1442 AH.
  • After reviewing the Royal Orders No. (64334) dated 11/11/1440 AH, No. (6899) dated 7/2/1442 AH, and No. (8662) dated 9/2/1443 AH.
  • After reviewing memoranda No. (2034) dated 2/7/1444 AH, and No. (604) dated 22/2/1445 AH, prepared by the Bureau of Experts at the Council of Ministers.
  • After reviewing the recommendation prepared by the Council of Economic and Development Affairs No. (3-28/44/D) dated 18/7/1444 AH.
  • After reviewing the recommendation of the General Committee of the Council of Ministers No. (2104) dated 29/2/1445 AH.
  • Decides the following:
  • First: Approval of the establishment of the National Center for Inspection and Control, in accordance with the accompanying organizational arrangements.
  • Second: The Board of Directors of the National Center for Inspection and Control shall exercise its powers stipulated in paragraph (6) of Article (Six) of the organizational arrangements - referred to in item (First) of this decision - in coordination with the Ministry of Finance and the Non-Oil Revenues Development Center, until the issuance and implementation of the regulations governing the practice of public authorities and institutions and their equivalents in imposing fees for the services and works they provide.
  • Third: Approval to conclude a contract between government entities - as defined in Article (One) of the organizational arrangements referred to in item (First) of this decision - and Riyadh Reemat Development Company owned by the Riyadh Municipality, whereby the company shall perform inspection and control tasks on behalf of the government entities concerned with inspection and control activities in Riyadh city, in accordance with the financial and contractual model approved by the Board of Directors of the National Center for Inspection and Control. The contract duration shall be five (5) years, renewable for similar periods after reviewing the financial and contractual model at each renewal. The company shall establish a subsidiary specialized in carrying out inspection and control tasks, which shall include representation from the government entities covered in the first phase of implementing the unified inspection and control work model - referred to in the study accompanying the letter of His Excellency the Minister of Municipal, Rural Affairs and Housing No. 4400358998 dated 4/5/1444 AH - in its Board of Directors, namely: (Ministry of Municipal, Rural Affairs and Housing, Ministry of Commerce, Ministry of Human Resources and Social Development, Saudi Food and Drug Authority, Riyadh Municipality, National Center for Inspection and Control). Coordination with the Non-Oil Revenues Development Center shall take place before signing or renewing the contract in accordance with Royal Order No. (6899) dated 7/2/1442 AH.
  • Fourth: The National Center for Inspection and Control shall evaluate the pilot application of the unified inspection and control work model - referred to in item (Third) of this decision - in Riyadh city within six (6) months from the start date of implementation. The Center shall have the authority to approve the most suitable model for generalization to other cities, whether through the concerned inspection and control entities contracting with municipalities and local authorities in other cities, contracting with the company to be established in Riyadh and converted into a company operating at the national level, or exploring other options and work models and approving the resulting contracts and the mechanism for transferring employees. Coordination with the Non-Oil Revenues Development Center shall take place before signing or renewing any contracts in accordance with Royal Order No. (6899) dated 7/2/1442 AH.
  • Fifth: The company to be established - pursuant to item (Third) of this decision - shall conduct a comprehensive evaluation of all employees associated with inspection and control tasks in the targeted government entities for unifying inspection and control work, based on evaluation and governance criteria approved by the Board of Directors of the National Center for Inspection and Control. These criteria shall be used to select qualified employees with distinguished technical competence and capability, in line with the needs and objectives of the company to be established, to be transferred thereto after concluding a contractual relationship between the entity and the company as per item (Third) of this decision, in accordance with the provisions of the rules and arrangements governing the treatment of employees and workers in the sectors targeted for transformation and privatization, issued by Council of Ministers Decision No. (616) dated 20/10/1442 AH.
  • Sixth: The National Center for Inspection and Control shall evaluate the government electronic platforms related to inspection and control tasks and propose solutions for their unification, whether through linking them together, selecting an existing platform and expanding its scope to include additional government entities, or establishing a new unified national electronic platform to manage inspection and control activities across all regions of the Kingdom. The Center shall coordinate with any relevant government entities to achieve this within one hundred eighty (180) days from the date of the Center’s establishment.
  • Seventh: Emphasis on government entities to link and update violation collection data with the National Violations Platform (Efa’a).
  • Eighth: The Non-Oil Revenues Development Center, in coordination with the relevant entities, shall propose the necessary procedures to increase the collection rates of fines and financial penalties within one hundred twenty (120) days from the date of issuance of this decision.

Article 1

  • The words and phrases listed below - wherever they appear in these arrangements - shall have the meanings specified next to each, unless the context requires otherwise:

  • The Center: The National Center for Inspection and Control.

  • The Organizational Arrangements: The organizational arrangements of the Center.

  • The Council: The Board of Directors of the Center.

  • The President: The President of the Council.

  • The Chief Executive Officer: The Chief Executive Officer of the Center.

  • Inspection and Control: The field visitation to verify the compliance of individuals and private sector establishments with the regulations, rules, instructions, and requirements, including the processes of monitoring and documenting violations.

  • Government Entities: The ministries, authorities, and similar bodies with independent public legal personality authorized by law to carry out inspection and control tasks and responsibilities.

Article 2

  • The center enjoys independent legal personality, as well as financial and administrative independence, and is organizationally linked to the Council of Ministers. Its headquarters is located in the city of Riyadh. It has the authority to establish branches and offices within the Kingdom as needed.

 

Article 3

  • The center aims to coordinate inspection and oversight efforts among government entities, and to explore the unification of what can be unified, in order to enhance the efficiency of inspection and oversight activities, and to improve the compliance rates of individuals and commercial establishments with the regulations, rules, and instructions.

 

Article 4

  • Without prejudice to the competencies of the relevant government authorities, the center, in order to achieve its objectives, may exercise - in cooperation with the relevant government authorities, each in its own regard - the following competencies:

  • 1- Developing policies, plans, and programs necessary for coordinating inspection and oversight activities among government authorities and unifying them where possible, and raising matters that require the completion of procedures in this regard.

  • 2- Reviewing the laws, regulations, instructions, and requirements related to inspection and oversight activities, proposing necessary amendments regarding them, and raising matters that require the completion of procedures in this regard.

  • 3- Identifying areas of inspection and oversight that can be unified, determining the targeted geographical scope for unifying inspection and oversight activities, and considering expanding or modifying the scope of unification in agreement with the relevant government authorities.

  • 4- Setting targets and plans for unifying inspection and oversight activities, supervising their implementation, and evaluating the results of applying the unification of inspection and oversight activities.

  • 5- Approving tools, models, guidelines, and standardized checklists for unified inspection and oversight activities.

  • 6- Reviewing the mechanism for forming committees to consider objections to violations and their operational procedures and tasks, proposing necessary amendments regarding them, and raising the proposed amendments to complete the applicable legal procedures.

  • 7- Preparing joint plans and campaigns with the relevant government authorities, periodically, to educate individuals and private sector establishments in order to raise compliance rates with laws, regulations, instructions, and requirements.

  • 8- Establishing the necessary controls and procedures that ensure transparency and integrity in the work of inspectors in unified inspection and oversight activities.

  • 9- Qualifying and licensing private sector companies that carry out inspection and oversight activities.

  • 10- Conducting research and studies on topics related to the center's objectives.

  • 11- Organizing and holding forums, conferences, and events related to inspection and oversight activities, and participating in them, in accordance with the applicable legal procedures.

  • 12- Cooperating and exchanging experiences with regional and international bodies and organizations, within the limits of the center's competencies, and according to the applicable legal procedures.

  • 13- Collecting information and statistics related to the center's field of work, utilizing them to develop inspection and oversight activities, and publishing what the center determines from information or statistics.

Article 5

Previous Amendments
  • The Center shall have a Board of Directors chaired by the Minister of Municipal and Housing Affairs, and membership shall include:

  • 1- A representative from the Ministry of Interior (General Directorate of Civil Defense).

  • 2- A representative from the Ministry of Municipal and Housing Affairs.

  • 3- A representative from the Ministry of Commerce.

  • 4- A representative from the Ministry of Human Resources and Social Development.

  • 5- A representative from the Ministry of Finance.

  • 6- A representative from the Ministry of Tourism.

  • 7- A representative from the Ministry of Investment.

  • 8- A representative from the Saudi Food and Drug Authority.

  • 9- A representative from the Saudi Data and AI Authority.

  • 10- The Chief Executive Officer.

  • The rank of the representatives of the government entities on the Board shall not be less than (fourteenth grade) or its equivalent.

Article 6

  • The Council is the supreme authority of the center, responsible for overseeing its affairs, managing it, and conducting its matters. It has the authority to make necessary decisions and procedures to achieve its objectives and exercise its powers within the provisions of the organizational arrangements. Specifically, it has the following responsibilities:

  • 1- Approving the policies, plans, and programs necessary for coordinating inspection and oversight activities among government entities, unifying them where possible, and raising matters that require completion of procedures.

  • 2- Proposing draft laws related to the center's objectives and competencies, and suggesting amendments to existing laws in preparation for submitting them for the completion of legal procedures.

  • 3- Approving the general policies of the center, its work plan, and its operational plans, which it follows to achieve its purposes, reviewing them, and monitoring their implementation.

  • 4- Approving the organizational structure of the center.

  • 5- Approving the administrative and financial regulations that the center operates under, as well as other internal and technical regulations necessary for its operations, provided that the approval of administrative regulations is in agreement with the Ministry of Human Resources and Social Development, and the approval of financial regulations and provisions with financial implications in other regulations is in agreement with the Ministry of Finance.

  • 6- Approving the financial fees for the services provided by the center.

  • 7- Approving the establishment of branches and offices for the center within the Kingdom.

  • 8- Approving the annual budget project for the center, and approving its final account, the report of its auditor, and its annual report; in preparation for submitting them according to the applicable legal procedures.

  • 9- Reviewing periodic reports submitted about the progress of work in the center, and the advancement in plans to unify inspection and oversight activities among government entities.

  • 10- Accepting gifts, donations, grants, bequests, and endowments offered to the center, in accordance with the regulations governing that.

  • 11- Appointing an external auditor (or more) and an internal financial controller.

  • 12- Approving the conclusion of agreements and contracts according to the applicable legal procedures.

  • 13- Approving the controls for the center's reliance on local and international expertise and consulting offices for studies and research.

  • The Council may delegate some of its powers to the President or to any member or employee of the center as it sees fit.

 

Article 7

  • The council may form permanent or temporary committees from its members or others, to which it delegates tasks as it sees fit. The decision to form each committee shall specify its chairperson, members, their remuneration, and their competencies. These committees may seek assistance from whomever they deem necessary to perform the assigned tasks.

 

Article 8

  • 1- The Council meetings are held at the headquarters of the center, chaired by the President or a member appointed by him from the representatives of government entities. If necessary, they may also be held at another location within the Kingdom.

  • 2- The Council meets - at the invitation of its President - once every (three) months, and whenever needed as deemed appropriate by the President. The President must call the Council to meet if at least (one-third) of its members request it, and the invitation to the meeting must be sent in writing at least (seven) days prior to the meeting, including the agenda of the meeting.

  • 3- A Council meeting is not considered valid unless attended by at least the majority of its members, including the President or his appointee.

  • 4- The Council's decisions are issued by a majority of the votes of the attending members, and in the event of a tie, the side that the President of the meeting voted for prevails.

  • 5- Council meetings may be held remotely, and decisions can be made by circulating them among the members, who sign to indicate their acknowledgment. Decisions made in this manner are not considered valid unless all members vote on them, and they must receive the approval of at least two-thirds of the members. Decisions made in this way are presented to the Council at the first subsequent meeting to be recorded in the meeting minutes.

  • 6- The discussions and decisions of the Council are recorded in minutes signed by the President of the meeting and the attending members. A dissenting member has the right to record their objection with justification in the minutes.

  • 7- No member of the Council may abstain from voting, nor may they delegate another member to vote on their behalf in their absence.

  • 8- The Council may invite any specialists and consultants it deems appropriate - whether from within the Kingdom or outside it - to attend its meetings and assist them, without having the right to vote.

  • 9- The Secretary of the Council is responsible for preparing for the Council meetings, notifying its members of the dates, and preparing the minutes and decisions, as well as any tasks assigned to him by the Council or the President.

 

Article 9

  • The center shall have a Chief Executive Officer appointed and dismissed by a decision of the Council, which specifies his salary and other financial benefits, and he shall be the executive responsible for managing the center and its daily operations. He shall, in particular, exercise the following authorities:

  • 1- Proposing the necessary policies, plans, and programs to coordinate inspection and oversight activities among government entities, and to unify what can be unified, without prejudice to the competencies assigned to other government entities, in preparation for submission to the Council.

  • 2- Proposing the general policies of the center, its work plan, and its operational plans, and submitting them to the Council and following up on their implementation after approval.

  • 3- Proposing the organizational structure of the center, its administrative, financial, internal, and technical regulations, as well as the procedures, rules, and standards necessary for its operations, and submitting them to the Council for approval.

  • 4- Supervising the workflow in the center, in accordance with the approved laws, regulations, plans, and programs.

  • 5- Issuing the necessary decisions to implement what is required by the organizational arrangements, regulations, rules, and approved procedures, according to the powers delegated to him.

  • 6- Supervising the preparation of the center's budget project, its annual report, and its final account, in preparation for presenting them to the Council.

  • 7- Appointing employees in the center in accordance with the regulations set by the center.

  • 8- Contracting with experts, consultants, and consulting firms from within the Kingdom or abroad to serve the center's objectives and competencies, in accordance with the regulations set by the center and the applicable legal procedures.

  • 9- Signing agreements, contracts, and other documents, after obtaining the Council's approval and in accordance with the applicable legal procedures.

  • 10- Representing the center before judicial, administrative, and other entities inside and outside the Kingdom. He may delegate others to do so.

  • 11- Disbursing from the center's budget and taking all financial actions in accordance with the approved laws and regulations, within the limits of the powers delegated to him by the Council.

  • 12- Submitting periodic reports to the Council on the center's activities, achievements, and initiatives.

  • 13- Any other competencies or powers assigned to him by the Council.

  • The Chief Executive Officer may delegate some of his competencies and powers to whomever he sees fit among the center's staff, in accordance with the regulations set by the center.
