1. The rules of disciplinary procedures apply to all trainees affiliated with the programs of the Saudi Commission for Health Specialties, and their provisions are applicable to every trainee enrolled in any training program supervised by the Commission, regardless of their employment or training status.
2. The disciplinary procedures stipulated in the general training regulation and these rules do not apply to violations committed by the trainee outside the premises of the Commission or the training centers, and do not affect the Commission or the training centers and the systems and regulations of the Commission and the framework of its various activities and participations - as these fall under the jurisdiction of other concerned authorities - unless referred to the Commission by the concerned authority, or if the origin of the violation is related to the Commission or the training center in any way.
Any actions or statements that violate the debt, the laws, the regulations, public order and public morals, or the instructions of the authority or the training center are considered a violation subject to disciplinary action. This includes the attempt, collusion, or assistance in committing any violation, whether the violation occurred in:
A. The authority.
B. The training center.
C. During the execution of external activities supervised by the authority or the training center.
D. While using the programs, devices, or applications provided by the authority.
1. Any statement or action by the trainee that affects Islamic Sharia, or the honor or dignity of others, or disrupts good conduct and behavior, or contradicts the proper morals that the trainee should embody.
2. Insulting the homeland or any of its symbols.
3. Theft.
4. Forgery of official and customary documents and papers.
5. Providing false or misleading information in forms or documents, whether during the application to the authority or during the training.
6. Possession, use, sale, promotion, or manufacture of prohibited or legally restricted substances.
7. Offering gifts, services, or money for the purpose of bribery.
8. Engaging in prohibited relationships or their antecedents.
9. Harassment or extortion.
10. Physical assault on others.
11. Verbal assault on others.
12. Assault on private property.
13. Threatening to inflict physical, psychological, or financial harm, or defaming any person.
14. Inciting tribal, customary, or regional tensions.
15. Accessing, photographing, disclosing, circulating, or publishing confidential documents, papers, or transactions in any manner.
16. Photographing the trainees, supervisors, or employees of the authority or trainees without the consent or knowledge of the person being photographed.
17. Deviating from the etiquette of politeness in interactions with colleagues or employees at the training center or the authority, or with the supervisors at the training center.
18. Violating the privacy of others.
19. Conducting any activity (event) without the approval of the relevant authorities.
21. Using the official seals of the authority or the training center.
21. False reports or malicious complaints.
22. Disrupting the programs and activities of the authority or the training center.
23. Resisting enforcement officials when apprehending an offender in the act.
24. Failing to comply with disciplinary procedures or resisting their implementation.
25. Being aware of any violation that undermines security and safety and failing to report it without a legitimate excuse.
26. Violating the instructions of the training center.
27. Any other violation that the authority deems to constitute a breach of its regulations, instructions, and decisions, for which there is no specific provision in these rules.
1. Using computers, email, social media, or other means of communication for unlawful purposes.
2. Cyber assault on the technical systems of the authority or the training center.
3. Bringing in media materials that include violations of Sharia or regulatory laws or disseminating them by any means of technology.
4. Using email to send or receive any prohibited materials.
5. Harming the reputation of the authority or the training center maliciously.
1. Breach of scientific integrity such as fraud in examinations or violation of intellectual property rights and ethics of professional practice and scientific research.
2. Disruption of the training process including organized absenteeism, or collusion to be absent.
3. Preparing a trainee for an absent trainee either in writing or verbally, or consenting to such preparation.
4. Illegally altering the deserved grade either on paper or electronically.
5. Knowledge of any training violation and failing to report it without a legitimate excuse.
The disciplinary penalties that may be imposed on the violating trainee include the following:
A. Written notice.
B. Written warning.
C. Final written warning with the trainee placed under observation.
D. Repeating the training period for a duration not exceeding three months during the entire program period.
E. Repeating the training period for a duration not exceeding twelve months during the entire program period.
F. Dismissal of the trainee.
G. Dismissal of the trainee and prohibition from enrolling in future training programs.
1. The consideration of violations committed by the trainee begins through the Training Program Committee.
2. The Training Program Committee submits its decisions or recommendations in the event that one of the violations is proven to the Institutional Training Committee or the Joint Training Committee (depending on the type of program) within a period not exceeding fifteen days from its submission according to the approved form, clarifying the grounds for the disciplinary procedure and attaching the documents that support the appropriate decision after listening to all concerned parties and documenting that according to the following details:
أ. Violations whose disciplinary procedures range between (warning, written warning):
1. The Training Program Committee issues a decision on the disciplinary procedure directly through it, within fifteen days from the date of the violation being proven, while informing the Institutional Training Committee or the Joint Training Committee (depending on the type of program) of the decision on the disciplinary procedure.
ب. Violations whose disciplinary procedures range between (final written warning with placing the trainee under observation and extending the training period for no more than three months):
1. The Training Program Committee issues its recommendation regarding the disciplinary procedure and submits it - without applying it - to the Institutional Training Committee or the Joint Training Committee (depending on the type of program) within a period not exceeding fifteen days from the date of the violation.
2. The Institutional Training Committee or the Joint Training Committee studies what has been submitted to it and makes its decision either to approve the disciplinary procedure recommended by the Training Program Committee or to amend it or reject it, based on what is submitted to it and after investigating all the facts related to the violation within a period not exceeding one month from the date it is received.
3. A decision on the disciplinary procedure is issued by the Institutional Training Committee or the Joint Training Committee (depending on the type of program), and the committee informs the trainee of the decision (with documentation of that) and the participating executive director of training in the training sector is provided with a copy of that within a period not exceeding one month from the issuance of the decision.
ج. Violations whose disciplinary procedures range between (extending the training period for more than three months, canceling the trainee's registration, canceling the trainee's registration with a ban on enrolling in training programs in the future):
1. The Training Program Committee issues its recommendation regarding the disciplinary procedure and submits it - without applying it - to the Institutional Training Committee or the Joint Training Committee (depending on the type of program) within a period not exceeding fifteen days from the date of the violation.
2. The Institutional Training Committee or the Joint Training Committee studies what has been submitted to it and makes its decision either to recommend approving the procedure recommended by the Training Program Committee or to amend it or reject it, based on what is submitted to it and after investigating all the facts related to the violation within a period not exceeding one month from the date it is received.
3. The Institutional Training Committee or the Joint Training Committee submits its recommendation through the participating executive director of training in the training sector to the Training Violations Committee in the authority in the event of approving the recommendation - without applying it - while in the case of rejecting the recommendation or mitigating the disciplinary procedure, the Training Program Committee is informed of that along with its justifications within a month from the date of rejection.
4. The Training Violations Committee in the authority considers the submitted violation and the recommendations of the training supervisory committees and issues its decision either to approve the recommended disciplinary procedure or to amend it or reject it, based on what is submitted to it and after investigating all the facts related to the violation within a period not exceeding three months from the date it is received.
5. A decision on the disciplinary procedure in this case is issued by the head of the Training Violations Committee in the authority.
6. The trainee and the training supervisory committees are informed through official communication channels about the disciplinary procedure, and the trainee's acknowledgment of being informed of the decision is documented according to the approved management forms.
7. The trainee's job reference is informed of the disciplinary action taken against him through the participating executive director of training in the training sector via official communication channels, for the following disciplinary actions: extending the training period for more than three months, canceling the trainee's registration, canceling the trainee's registration with a ban on enrolling in training programs in the future.
8. The trainee has the right to appeal the disciplinary decisions issued against him according to the specified mechanism in the appeal mechanism mentioned in Chapter Six of these rules.
