General Regulations for Holding Temporary Camel Auctions Outside Public Utility Markets

  • Based on the powers granted to him by law

  • After reviewing the Agriculture Law issued by Royal Decree No. (M/64) dated 10/8/1442 AH, and its Implementing Regulation issued by Ministerial Decision No. (14967/1/1444) dated 15/1/1444 AH, and pursuant to the approval of His Excellency the Minister, explained on 11/3/1444 AH, on the letter of the General Directorate of Legal Affairs No. (26555/2384/1444) dated 9/3/1444 AH, delegating the Deputy Minister of Agriculture the authority to issue technical guides related to the Implementing Regulation of the Agriculture Law, issue its specific conditions and regulations, amend them, and as required by the interest of work.

  • Decides the following:

    • First: Approval of the "General Regulations for Holding Temporary Camel Auctions Outside Public Utility Markets" in the attached form.

    • Second: This decision shall come into effect from the date of its publication, and shall be communicated to those concerned for its approval and enforcement, and all previous decisions that conflict with it are hereby repealed.

Introduction

  • Referring to paragraph (1) of Article Eighty-Eight of the Implementing Regulation of the Agriculture System issued by Royal Decree No. (M/64) dated 10/8/1442 AH, which states that the Ministry or its authorized representative shall determine the appropriate locations for establishing seasonal and permanent markets for the trading and sale of various types of livestock, and trading in unlicensed places by the Ministry is prohibited.

First: Site Regulations

  • 1- The auction site must be located outside the urban area of cities, governorates, and villages by no less than (5 km).

  • 2- A veterinary clinic must be available for veterinary supervision of the health of the camels offered for sale.

  • 3- The site must be easily accessible and equipped with communication and internet services.

  • 4- All works, preparations, and materials must be executed in accordance with the approved standard specifications.

  • 5- Compliance with the approval of all design works and supervision of the auction's implementation, which is to be established by engineering offices and contractors accredited by the Ministry.

  • 6- Provision of designated areas for administrative staff, security and guard personnel, and seating areas for attendees.

  • 7- Compliance with the requirement that entry and exit be through a single gate.

  • 8- Not to harm the roads, facilities, and surrounding environment (pedestrian pathways, routes) or neighbors, and to adhere to maintaining the environment without causing any damage to the site, securing the sides of excavations, and ensuring engineering supervision over all works.

  • 9- All electrical installations must be safe according to standard specifications and the Saudi Building Code, to ensure adequate artificial lighting for safe exits and control of individual movements in the auction venue prepared for a large number of individuals, with the lighting units in the area divided into two or more electrical supply circuits, and switches or lighting control equipment placed in a manner that is not accessible to the public in halls prepared for more than 50 individuals, while applying the requirements of items No. (9-718:55 and 718:53) from the Saudi Electrical Code (SBC401).

  • 10- Provision of necessary emergency lighting in the venue with a source, ensuring that the main electrical distribution boards and control panels are locked and can only be opened with special tools or keys, or that they are inside locked rooms, and that the external electrical boards, rooms, and stations designated for feeding the project are within the boundaries of the project's designated site.

  • 11- Compliance with conducting periodic inspections of all electrical equipment and installations and repairing any faults or malfunctions.

  • 12- Compliance with any new requirements issued later by the relevant authorities.

Secondly: Requirements for Establishing Seasonal Markets and Auctions

  • 1- The existence of an organized entity for the market or auction that bears all financial and organizational burdens.

  • 2- The purpose of establishing the seasonal market or auction and the duration of the market is specified.

  • 3- It is preferable that it does not affect the movement and activity of the public utility market in the area.

  • 4- The role of the Ministry is to provide technical supervision over the auction.

  • When the above criteria are met, a request is submitted to the branch in the area for final approval, accompanied by the following:

    • A- An official request from the organizing entity of the seasonal market or auction, clarifying the purpose of establishing the market or auction and that it bears all financial and administrative burdens.

    • B- Submission to the branch of the Ministry in the area for final approval.

Thirdly: Regulations for Sale and Purchase in Seasonal Auctions

  • 1- Obligation to transfer the ownership of the sold camels in accordance with the legal procedures.

  • 2- The sale of any type of camel is prohibited unless it meets the vaccination programs approved by the Ministry and is vaccinated by a person or entity licensed by the Ministry.

  • 3- The sale or display of any animal showing signs of stress or disease symptoms is prohibited, and it must be promptly isolated in a location away from other healthy animals.

  • 4- Compliance with the service provider regulations issued by the Ministry according to Article No. (38) of the Implementing Regulation of the Agriculture Law.

  • 5- Use of electronic payment, preferably through an electronic platform.

  • 6- Localization according to the directives of the relevant authorities.

  • 7- Registration of all parties involved in the auction: camel owners, service providers, cooperative societies, transportation means.

  • 8- Any rules and regulations determined by the branch or auction management according to the size of the auction and the transactions therein after obtaining approval from the authorized person.

Fourth: Days and Hours of Work in Auctions

Fifth: Recording the quantities and prices in the auction

  • 1- Information related to camels is recorded, including the name of the camel owner, the type of camels, their color, the transfer license, and any information that may assist in future management and control.

  • 2- Recording the prices of camels, the names of the seller and buyer, and the method of payment.

  • 3- Recording market information according to Form No. (1) and information about the camel auction.

Sixth: Biosecurity and the preservation of public health and the safety of the agricultural sector's resources.

  • 1- The operating company or the investor of the auction shall carry out cleaning, maintenance, and security services for the auction facilities.

  • 2- A daily report on cleaning and maintenance activities shall be submitted using Form No. (2).

  • 3- All participants in the auction are required to dispose of waste in the designated areas.

  • 4- Regular cleaning and disinfection of waste containers and areas prone to contamination.

  • 5- Pest control for insects, rodents, and stray animals shall be conducted using mechanical methods (traps and adhesives) and chemical methods, ensuring that it does not affect the safety of festival visitors, with clear schedules as needed.

Seventh: Licenses

Previous Amendments
  • 1- The Ministry issues licenses for shops, pens, and stalls through the (Nama Platform), as well as permits for individuals working in the auction, whether affiliated with shops or freelancers, as detailed in the Service Providers Regulations.

  • 2- The duration of the licenses corresponds to the duration of the auction.

  • 3- The Ministry has the right to cancel licenses if the auction is canceled.

  • 4- Shops without specific requirements, such as grocery stores, restaurants, and others, are subject to the requirements issued by the Ministry of Municipal and Rural Affairs and Housing.

  • 5- Procedures for issuing, renewing, and canceling licenses and permits in auctions.

    • A- Issuing licenses:

      • 1- Submit a new license application on the (Nama Platform).

      • 2- Attach the following:

        • A- A valid lease contract with an activity compatible with the licenses from the auction resident.

        • B- An updated agricultural or commercial register that is valid and compatible with the licenses.

        • C- A copy of the owner's identity if an individual or an institution.

        • D- A photo of the shop signboard from inside and outside showing the following:

          • - Implementation of the requirements for the activity to be licensed.

          • - A photo of the shop signboard according to the market's specific identity.

          • - Provision of civil defense requirements.

      • 3- It is referred to the market specialists to verify that the shop meets the required activity conditions.

      • 4- Issuance of the license through the platform.

    • B- Individual permits:

      • 1- Service providers who meet the conditions specified in the Service Providers Regulations issued by the Ministry Agency are permitted as follows:

        • A- Submit an application on the Nama Platform to issue a permit to practice service in (Marketing Service - Loading and Unloading Service - Maintenance and Cleaning Service).

        • B- Attach a professional certificate or freelance work document compatible with the service they wish to practice.

        • C- After verifying the requirements are met, a service provider permit is issued by the Market Management.

        • D- Display the permit clearly.

        • E- Wear the vest (uniform) specified by the Auction Management.

      • 2- Permits for employees affiliated with camel owners or licensed shops, stalls, and pens working in the auction are issued as follows:

        • A- Apply on the Nama Platform, fill out the forms, and attach the following:

          • - Identity (ID card – residence permit).

          • - License of the shop where they work.

          • - Work contract.

        • B- Verify the requirements are met and issue the permit.

        • C- Display the permit clearly.

        • D- The license duration corresponds to the auction duration.

Eighth: Monitoring Violations

  • Work is conducted in accordance with the classification and determination of penalties schedule and the regulations for violations issued by the Ministry.
